How Indian Customs Calculates Import Tariffs

Accurate HS classification is legally critical under the Customs Act, 1962 and Special Valuation Branch (SVB) scrutiny.

Assessable Value (CIF)

Rule 1
FOB Factory Value + Ocean/Air Freight + 1% Insurance

Indian Customs determines duties on the CIF (Cost, Insurance, Freight) landed value in Indian Rupees using CBIC notified exchange rates.

Basic Customs Duty (BCD)

Rule 2
Assessable Value × BCD Rate (Typically 7.5% to 25%)

The baseline tariff defined in the First Schedule to the Customs Tariff Act, 1975, varying by exact 8-digit HS Code.

Social Welfare Surcharge (SWS)

Rule 3
10% on the calculated BCD amount

Levied at a flat 10% on the aggregate customs duties (BCD) payable on the imported goods.

Integrated Goods & Services Tax (IGST)

Rule 4
(Assessable Value + BCD + SWS) × 18% or 28%

Calculated on the total value after adding customs duties. Eligible importers can claim this as Input Tax Credit (ITC).
